The Indian personal law system is perceived to be controversial for many reasons, and the question of how it should be reformed is fiercely debated. Despite the depth of the debate (especially on gender-related issues) and its persistence over several decades, one question in particular hasreceived little attention: the impact the personal law system has on religious freedom. This book will fill this gap in our understanding of the personal law system by evaluating it against the value of religious freedom. It concludes that, overall, the personal law system harms religious freedom. Its findings imply that concerns relating to religious freedom constitute an important set of objections to the personal law system and that there is reason to believe that the system needs to be reformed in order to address these concerns. The book then considers several reform proposals, including certain modifications of the personal law system, a move towards a millet system, "internal" reform of individual personal laws and the introduction of a Uniform Civil Code. It particularly focuses on one reform possibility-religiousalternative dispute resolution-which has not been considered closely enough in the Indian context.
